and Hazel Murphy, Statutory guardian of Ruby Horn, principals, and Rosco
Kirk, and W. R. McCohy and James Horn, sureties, bind ourselves to Oppy
Horn, John Horn, George Horn, and Ruby Horn, that the said Rosa Horn and
Hazel Murphy, as guardians for said infants will faithfully discharge all
the duties as such, and will comply with the judgment and orders of this
Court in said action, and will act for, pay and deliver to the said Oppy
Horn, John Horn, George Horn and Ruby Horn all money or property due or
belonging to them when requested.

The deposition of Rosa Horn, Hazel Murphy, Will Horn and James Horn, taken
at the law office of W.R. McCoy, in the town of Inez, Martin County,
Kentucky, on the 10th day of March, 1945, to be read on behalf of the
plaintiffs.
The witness, Rosa Horn, being duly sworn, deposes and says: Direct
Examination by W. R. McCoy:
Q. Your name is Rosa Horn?
A. Yes, sir.
Q. How old are you, Mrs. Horn?
A. Fifty-two (52)
Q. How many children have you, and what are their names?
A. Mae, Wallace, Curtis, Vina, Oppy Louise, George, John, and Daisy
Q. What was your husband name?
A. George Horn.
Q. Is he living or dead?
A. He is dead.
Q. What was his father's name?
A. John Horn.
Q. Which died first, John Horn, or his son George, if you remember.
A. George died first.
Q. And at the time your husband, George Horn, died was the children that
you mentioned all living?
A. Yes, sir, but the two twins weren't born.
Q. Then, John and George were born after their father's death?
A. Yes, sir.
Q. How long after this death?
A. Eighteen (18) days.
Q. What kind of land was this that John Horn owned at the time of his
death?
A. Just a rough hillside.
Q. Do you know how many children John Horn had living when he died?
A. Eleven.
Q. I believe you as guardian was selling the infants' interest here for
$25.00 to Walter Johnson?
A. Yes, sir.
Q. Do you feel that that was a fair price for this land?
A. Yes, I do.
Q. They didn't own the mineral on it, did they?
A. No.
Q. Does these children of yours receive any income from it?
A. Nothing.
Q. In other words they were receiving no benefits by reason of having it?
A. No sir.
Q. Is there enough of it to divide it up into eleven parts?
A. No sir. I wouldn't want a part in it.
Q. You feel then that it would be to the interest of the children to sell
that property at this time?
A. Yes, sir
Q. Do they have any income of any kind, except from your labor?
A. No.

A. She is nineteen (19).
Q. Are you acquainted with the land Micheal Horn's daughters owned?

Q. Has Ruby Horn any money or income, except what you provide for her?
A. She is working at the present time.
Q. But she has no income except from her labor?
